These Terms and Conditions ("Terms") are a legal agreement between you and Ferocious Media Group, LLC ("Ferocious Media," "we," "us," or "our"), located at 320 1st St N Ste 714, Jacksonville Beach, FL 32250. These Terms govern your use of our website at https://ferociousmedia.com and any website of ours that links to these Terms (the "Site"), and your participation in our SMS/text messaging program (the "SMS Program"). By using the Site or opting in to the SMS Program, you agree to these Terms. If you do not agree, please do not use the Site or opt in to text messages.

Our Privacy Policy explains how we collect, use, and protect your information and is part of these Terms.

1. SMS / Text Messaging Program Terms

Program description

Ferocious Media's SMS Program sends text messages to people who have opted in, including appointment reminders, service updates, scheduling confirmations, responses to inquiries, and marketing messages (such as offers and promotions) about Ferocious Media's digital marketing services.

How you opt in

You can opt in by checking the SMS consent box on a form on our website, or by otherwise giving us express consent to receive text messages. By opting in, you agree to receive recurring automated text messages from Ferocious Media at the mobile number you provided. Consent to receive text messages is not a condition of purchase, and the SMS consent box is always optional.

Message frequency

Message frequency varies. You can expect to receive 5–10 messages per month based on your project or service needs.

Message and data rates

Message and data rates may apply depending on your mobile carrier and plan. Contact your wireless provider for details about your text or data plan.

How to opt out

You can cancel the SMS Program at any time by replying STOP to any message. After you reply STOP, you will receive one final message confirming that you have been unsubscribed, and you will receive no further text messages from us. If you want to rejoin, reply START or sign up again as you did the first time. Opting out of text messages does not affect other parts of your relationship with Ferocious Media.

Carrier liability

Carriers are not liable for delayed or undelivered messages.

Eligibility

The SMS Program is available to people with a valid mobile number in the United States. By opting in, you confirm that you are the account holder for that mobile number or have the account holder's permission, and that you are at least 18 years old. If you change or deactivate your mobile number, please reply STOP from that number or contact us so we can remove it.

Privacy and no sharing of mobile information

We use the information you provide through the SMS Program only as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. We may share information with service providers who help us deliver messages and support our customers (such as messaging platforms), only as needed to provide the SMS Program.

Changes to the SMS Program

Ferocious Media may modify or discontinue the SMS Program at any time. We will update these Terms if the program's material terms change.

2. Our Services

Ferocious Media provides digital marketing services, including website design and development, search engine optimization, paid advertising, social media management, local SEO, and graphic design. Information on the Site about our services is for general informational purposes. Any paid services we provide to clients are governed by a separate written agreement between Ferocious Media and that client. If that agreement conflicts with these Terms, the written agreement controls for those services.

3. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable federal, state, or local law;
  • Submit false, misleading, or someone else's information through forms on the Site, including a mobile number you are not authorized to use;
  • Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
  • Introduce viruses, malware, or other harmful code, or interfere with the Site's operation; or
  • Use automated means to scrape, copy, or collect content from the Site without our written permission.

Information you submit through the Site must be true, complete, and accurate.

4. Intellectual Property

The Site and its content, including text, graphics, logos, images, and design, are owned by Ferocious Media or its licensors and are protected by copyright, trademark, and other laws. You may view and print content from the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from Site content without our prior written permission. Ownership of work we create for clients is addressed in each client's written agreement.

5. Third-Party Links and Services

The Site may contain links to third-party websites or services that we do not own or control. We are not responsible for the content, privacy practices, or availability of those sites. Accessing them is at your own risk and subject to their own terms and policies.

6. Disclaimers

The Site and its content are provided "as is" and "as available," without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, secure, or error-free. Results, case studies, and performance figures described on the Site reflect specific circumstances and are not a guarantee of future results.

7. Limitation of Liability

To the fullest extent permitted by law, Ferocious Media and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site or the SMS Program, even if we have been advised of the possibility of such damages.

8. Indemnification

You agree to indemnify and hold harmless Ferocious Media and its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Site or the SMS Program.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising out of these Terms or your use of the Site will be resolved in the state or federal courts located in Duval County, Florida, unless otherwise required by applicable law.

10. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by the "Last updated" date at the top of this page. Your continued use of the Site or the SMS Program after changes are posted means you accept the updated Terms.
